In these Terms and Conditions, “Luxso”, “we”, “us” and “our” refer to GIXEN PTY LTD trading as Luxso.

2. Acceptance of These Terms

By accessing or using this website, creating an account or placing an order, you agree to be bound by these Terms and Conditions and our Privacy Policy.

You must not use this website or place an order if you do not agree to these Terms and Conditions.

We may update these Terms and Conditions from time to time. The version applying to an order will be the version displayed on the website when the order is placed.

3. Alcohol Warning, Liquor Licence and Age Restrictions

This website sells alcoholic products and is intended only for persons aged 18 years or over.

It is against the law to sell or supply alcohol to a person under the age of 18.

Our Victorian liquor licence number is: 36314821. The licensee is GIXEN PTY LTD (ACN 685 392 643).

By accessing the online store, creating an account or placing an order, you confirm that:

  • you are at least 18 years of age;
  • the person purchasing the alcohol is at least 18 years of age;
  • the intended recipient of the order is at least 18 years of age;
  • the information you provide regarding your identity and age is accurate; and
  • you are not purchasing alcohol on behalf of a person under 18 years of age.

We may request evidence of age before accepting or fulfilling an order. We may cancel or refuse an order where we cannot reasonably verify that the purchaser or recipient is at least 18 years of age.

4. Responsible Service and Quantity Limits

Alcohol should be consumed responsibly.

Products purchased through this website must not be supplied to minors or consumed in breach of applicable laws.

Information displayed on the website is not intended to encourage excessive or irresponsible consumption of alcohol.

We may, acting reasonably and consistently with responsible service of alcohol principles and our liquor licence conditions:

  • limit the quantity of products that may be purchased per order, per customer or per delivery address;
  • refuse or cancel an order that appears to be inconsistent with the responsible service of alcohol;
  • refuse or cancel an order that appears to be intended for unauthorised commercial resale; and
  • refuse or cancel an order where required to comply with our liquor licence conditions or applicable law.

5. Website Use

You agree to use this website only for lawful purposes.

You must not:

  • use the website in a way that breaches any applicable law;
  • provide false, misleading or fraudulent information;
  • attempt to gain unauthorised access to the website, its server or connected systems;
  • interfere with the security or operation of the website;
  • introduce viruses, malicious code or other harmful material;
  • reproduce or commercially exploit website content without our permission; or
  • purchase alcohol for a person under 18 years of age.

We may restrict, suspend or terminate access to the website where we reasonably believe these Terms and Conditions have been breached.

6. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, vintages, bottle sizes, alcohol content, pricing and availability are accurate.

Product images are provided for illustrative purposes. Packaging, labels, vintages, colours and presentation may vary from the images displayed.

While we aim to provide accurate information, minor errors or omissions may occur. Nothing in this section excludes any rights you may have under the Australian Consumer Law.

7. Perishable Products, Storage and Transit Conditions

Some of our products, including cream liqueurs, contain dairy or other perishable ingredients and are sensitive to heat, sunlight and temperature variation.

You acknowledge that:

  • products may be exposed to ambient temperatures during transit and while awaiting collection or acceptance of delivery, and we do not control the transport and storage conditions of the carrier;
  • orders should be accepted or collected promptly and should not be left in direct sunlight, in vehicles or in hot locations;
  • products must be stored in accordance with the instructions on the label, including refrigeration after opening where indicated; and
  • cream liqueur products should be consumed within the period indicated on the label after opening.

We take reasonable care in packaging products appropriately for transport. To the maximum extent permitted by law, we are not liable for deterioration, spoilage or change in the condition, texture or appearance of a product caused by failure to follow storage or handling instructions after delivery, by delayed collection or acceptance of a delivery, or by temperature exposure during transit that is outside our reasonable control.

Nothing in this section excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law, including in relation to products that were not of acceptable quality at the time of supply.

8. Orders

An order submitted through the website is an offer by you to purchase the selected products.

An order is not accepted until we have:

  • successfully received payment;
  • completed any required age or identity checks;
  • confirmed product availability; and
  • issued an order confirmation or commenced processing the order.

We reserve the right to accept or reject an order, including where:

  • a product is unavailable;
  • pricing or product information contains an error;
  • payment cannot be processed;
  • we suspect fraud or unauthorised activity;
  • legal or licensing requirements prevent us from supplying the order;
  • the delivery address cannot be serviced;
  • we cannot verify that the purchaser or recipient is at least 18 years old; or
  • an order appears to have been placed for commercial resale without prior approval.

Where we cancel an order after payment has been received, we will refund the amount paid for the cancelled products using the original payment method, unless otherwise agreed.

9. Pricing and GST

All prices are displayed in Australian dollars and include GST where applicable, unless stated otherwise.

Delivery charges are calculated and displayed during checkout.

We may change prices at any time. Price changes will not affect an order that has already been accepted, except where there has been an obvious pricing error.

If a product has been incorrectly priced, we may contact you to offer the option of purchasing it at the correct price or cancelling the affected item.

10. Payments and Chargebacks

Payments made through this website are processed using Stripe.

You agree to provide current, complete and accurate billing and payment information.

Luxso does not directly receive or store your complete payment card details. Payment information is processed by Stripe in accordance with Stripe’s own terms and privacy practices.

Your order may be cancelled if payment is declined, reversed, disputed or suspected to be fraudulent.

If you have a concern about a transaction, please contact us at info@luxso.com.au before initiating a chargeback, so that we can attempt to resolve the issue directly.

Where a chargeback or payment dispute is initiated that we reasonably believe to be unfounded, we may:

  • provide transaction, age-verification and delivery evidence to the payment provider or card issuer;
  • suspend the fulfilment of pending orders and the use of your account until the dispute is resolved; and
  • recover from you amounts properly owed to us, including reasonable costs incurred in responding to the dispute, to the extent permitted by law.

Nothing in this section limits your right to raise a genuine payment dispute or any rights you have under the Australian Consumer Law.

11. Product Availability

All products are subject to availability.

Occasionally, a product may become unavailable after an order has been submitted. If this occurs, we may:

  • offer a suitable replacement with your approval;
  • remove the unavailable product and refund its purchase price; or
  • cancel and refund the affected order.

We are not required to provide a substitute product without your agreement.

12. Australian Delivery

We currently deliver throughout Australia using Australia Post.

Delivery timeframes displayed on the website are estimates only and may vary due to the destination, public holidays, weather, carrier delays or circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. We are not responsible for delays or additional costs caused by an incorrect or incomplete address provided by you.

Orders cannot be delivered to locations where alcohol delivery is prohibited or where applicable licensing, carrier or legal requirements cannot be satisfied.

13. Alcohol Delivery, Proof of Age and Unattended Delivery

Alcohol may only be delivered to a person who is at least 18 years of age.

The recipient may be required to:

  • provide valid photographic identification;
  • provide their name and signature;
  • confirm that they are at least 18 years old; and
  • comply with Australia Post’s age-verification and delivery procedures.

Australia Post or its delivery representative may refuse to deliver an order where:

  • the recipient cannot provide acceptable proof of age;
  • the recipient appears to be under 18;
  • no eligible adult is available to accept the delivery;
  • the recipient appears intoxicated;
  • the delivery would breach applicable law or licence conditions; or
  • the delivery circumstances are unsafe or unsuitable.

Unattended delivery (“Authority to Leave”) is not available for alcohol orders, except where it is permitted by applicable law, carrier requirements and our liquor licence conditions and you have expressly requested it.

Where an unattended delivery is lawfully permitted and made at your express request, the products are at your risk from the time they are left at the nominated address, and we are not responsible for loss, theft, damage or deterioration (including heat exposure) occurring after the products have been left.

If an order cannot be delivered because proof of age cannot be provided, an eligible adult is unavailable or incorrect delivery information was supplied, the order may be returned to us. You may be responsible for reasonable return and redelivery costs.

Any refund issued for an undeliverable order may be reduced by the original delivery charge, return delivery costs and reasonable handling costs, except where the failed delivery resulted from our error or where otherwise required by law.

14. Delivery Delays

Once an order has been dispatched, delivery is managed by Australia Post.

We are not responsible for delays caused by events outside our reasonable control, including carrier disruptions, natural disasters, extreme weather, industrial action, transport interruptions or incorrect delivery information.

This does not exclude any rights or remedies available under the Australian Consumer Law.

Please contact us at info@luxso.com.au if your order has not arrived within a reasonable period after its expected delivery date.

15. Risk and Ownership

Ownership of the products passes to you once full payment has been received.

Risk in the products passes to you when they are delivered to the nominated delivery address, collected in accordance with the carrier’s authorised collection process, or left at the nominated address pursuant to a lawfully permitted unattended delivery made at your express request.

Nothing in this section limits your rights if the products are damaged, faulty or not supplied in accordance with the Australian Consumer Law.

16. International Delivery Enquiries

The website currently accepts orders for delivery within Australia only.

For international delivery enquiries, please contact info@luxso.com.au before placing an order.

International delivery is not guaranteed and will be considered individually at Luxso’s discretion. Any international supply will be subject to:

  • applicable Australian export requirements;
  • the laws and alcohol import restrictions of the destination country;
  • carrier availability;
  • customs duties, taxes and import charges;
  • age-verification requirements; and
  • Luxso’s liquor licence conditions.

The customer is responsible for confirming that the products may lawfully be imported into the destination country and for paying applicable duties, taxes, customs fees and other charges.

17. Change-of-Mind Returns

Please choose carefully.

Luxso does not offer refunds, returns, credits or exchanges where you:

  • change your mind;
  • no longer want the product;
  • order the wrong product;
  • dislike the product’s taste, aroma or personal characteristics;
  • find the product available elsewhere at a lower price;
  • fail to accept delivery;
  • provide an incorrect delivery address; or
  • fail to comply with age-verification or delivery requirements.

Luxso may agree to a change-of-mind return in exceptional circumstances at its sole discretion.

Any discretionary return must be approved by Luxso in writing before the product is sent back.

Where a discretionary return is approved:

  • the product must be unopened, unused, undamaged and in its original saleable packaging;
  • the customer must follow the return instructions provided by Luxso;
  • the customer is responsible for return delivery costs;
  • original delivery charges are not refundable; and
  • reasonable handling or restocking costs may be deducted from the refund.

We may refuse a discretionary return if the product has been opened, damaged, improperly stored, altered or returned without prior approval.

This change-of-mind policy does not limit any rights available under the Australian Consumer Law.

18. Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

You may be entitled to a remedy if a product:

  • is faulty or defective;
  • is unsafe;
  • is not of acceptable quality;
  • does not match its description;
  • is not fit for a disclosed purpose; or
  • otherwise fails to comply with a consumer guarantee.

For a major failure, you may be entitled to reject the product and choose a refund or replacement, or obtain compensation for the reduction in value of the product.

For a failure that is not major, we may be entitled to provide an appropriate remedy within a reasonable time.

A problem may not amount to a failure under the Australian Consumer Law if it was caused by misuse, improper storage, accidental damage, normal deterioration or a failure to follow reasonable handling instructions after delivery.

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

19. Damaged, Faulty or Incorrect Products

Please inspect your order as soon as reasonably possible after delivery.

If a product arrives damaged, faulty, leaking, broken or materially different from the product ordered, contact us promptly at info@luxso.com.au.

Please provide:

  • your name;
  • your order number;
  • a description of the issue;
  • clear photographs of the product;
  • photographs of the packaging and shipping label where relevant; and
  • any other information reasonably required to assess the claim.

You should retain the product and its packaging until we advise whether they are required for inspection or return.

Where the product does not comply with the Australian Consumer Law, we will provide an appropriate remedy, which may include a refund, replacement or another remedy required by law.

We will cover reasonable return delivery costs where a product is confirmed to be faulty, damaged, incorrect or otherwise returnable under the Australian Consumer Law.

Please do not dispose of a damaged product until we have provided instructions, unless keeping it would be unsafe.

20. Incorrect Delivery Information and Returned Orders

You are responsible for checking that your name, email address, delivery address and other order details are correct before submitting your order.

If an order is returned because:

  • an incorrect or incomplete address was supplied;
  • the recipient was unavailable;
  • proof of age was not provided;
  • the parcel was not collected;
  • delivery was refused without a valid consumer-law reason; or
  • the carrier could not complete delivery due to circumstances within the recipient’s control,

we may require payment of reasonable redelivery charges before sending the order again.

Where you request a refund for an order returned in these circumstances, we may deduct non-refundable delivery and return costs, except where prohibited by law.

21. Cancellations and Order Changes

Contact us as soon as possible at info@luxso.com.au if you need to change or cancel an order.

We cannot guarantee that an order can be changed or cancelled after it has been submitted. Once an order has been processed, packed or dispatched, it may no longer be possible to cancel or amend it.

If we agree to cancel an order before dispatch, we will refund the applicable amount using the original payment method.

Your rights under the Australian Consumer Law remain unaffected.

22. Promotions and Discount Codes

Promotions, special offers and discount codes may be subject to additional conditions.

Unless stated otherwise:

  • discount codes cannot be exchanged for cash;
  • only one discount code may be used per order;
  • codes must be applied before checkout is completed;
  • discounts cannot be applied retrospectively;
  • promotions are subject to product availability; and
  • Luxso may withdraw or amend a promotion where reasonably necessary.

Promotions must not be used fraudulently or in combination with unauthorised discounts.

23. Accounts

You may be able to create an account through the website.

You are responsible for:

  • keeping your login information confidential;
  • ensuring your account details are accurate;
  • restricting unauthorised access to your account; and
  • notifying us promptly if you suspect unauthorised activity.

You are responsible for activity conducted through your account unless it resulted from our failure to take reasonable security precautions.

We may suspend or close an account that is used fraudulently, unlawfully or in breach of these Terms and Conditions.

24. Intellectual Property

Unless otherwise stated, the website and its content are owned by or licensed to Luxso.

This includes text, photographs, graphics, logos, product descriptions, branding, videos, website design and other materials.

You may view and use the website for personal, non-commercial purposes.

You must not copy, reproduce, modify, distribute, publish, display, sell or commercially exploit website content without our prior written permission, except as permitted by law.

25. Third-Party Services and Links

The website may use or contain links to third-party platforms and services, including WooCommerce, Stripe, Google Analytics, Meta platforms and Australia Post.

Third-party services are governed by their own terms and privacy practices.

We are not responsible for the content, security, availability or practices of independent third-party websites, except to the extent that responsibility cannot be excluded by law.

26. Website Availability

We aim to keep the website accurate, secure and available. However, we do not guarantee that access will always be uninterrupted or error-free.

We may temporarily suspend access for maintenance, upgrades, security issues or circumstances outside our control.

We do not guarantee that the website will be free from viruses or other harmful components, although we take reasonable precautions to protect it.

27. Consumer Sales Only

This website is intended for retail sales to consumers only.

Wholesale, trade, on-premise, distribution and export orders are subject to a separate written agreement with Luxso and are not governed by these Terms and Conditions.

We may cancel or refuse an order that appears to be a trade or wholesale purchase made without our prior written approval.

28. Limitation of Liability

To the maximum extent permitted by law, Luxso is not liable for indirect, incidental, special or consequential loss arising from your use of the website or products, including loss of profits, loss of revenue, loss of business opportunity, loss of goodwill or loss of data.

To the maximum extent permitted by law, where our liability may lawfully be limited, our liability for a failure to comply with a consumer guarantee in relation to goods is limited, at our option, to the replacement of the goods, the supply of equivalent goods, or the payment of the cost of replacing the goods or acquiring equivalent goods.

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with an order is limited to the amount paid by you for the products giving rise to the claim.

Nothing in these Terms and Conditions excludes or limits liability that cannot legally be excluded or limited, including liability arising under the Australian Consumer Law.

29. Indemnity

To the extent permitted by law, you agree to indemnify Luxso against loss, liability, damage or reasonable costs arising from:

  • your unlawful use of the website;
  • your material breach of these Terms and Conditions;
  • fraudulent information supplied by you; or
  • your purchase or supply of alcohol to a person under 18 years of age.

This indemnity does not apply to loss caused by Luxso’s negligence, unlawful conduct or breach of a non-excludable legal obligation.

30. Force Majeure

We are not liable for any delay in performing, or failure to perform, our obligations under these Terms and Conditions where the delay or failure is caused by an event outside our reasonable control.

Such events include, without limitation: fire, flood, storm, earthquake or other natural disaster; epidemic or pandemic; war, terrorism or civil unrest; industrial action or strikes; failure of suppliers, manufacturers or co-packers; carrier or transport disruptions; utility, telecommunications or internet failures; cyber incidents; and acts of government, regulators or licensing authorities.

If a force majeure event occurs, our affected obligations are suspended for the duration of the event. If the event continues for more than 30 days, either party may cancel the affected order, and we will refund amounts paid for products that have not been supplied.

This clause does not affect your obligation to pay for products that have been delivered, and does not exclude any rights or remedies available under the Australian Consumer Law.

31. Privacy

Your personal information is handled in accordance with our Privacy Policy, the Privacy Act 1988 (Cth) and applicable privacy laws.

By placing an order, you acknowledge that we may disclose necessary information to service providers such as Stripe, WooCommerce, website hosting providers, Australia Post and other businesses involved in processing or delivering your order.

32. Assignment

We may assign, novate or otherwise transfer any or all of our rights and obligations under these Terms and Conditions, including in connection with a sale, transfer or restructure of our business or assets, without your consent. Any such assignment or novation will take effect upon notice published on the website or otherwise provided to you.

You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent.

33. Governing Law

These Terms and Conditions are governed by the laws of Victoria, Australia.

You submit to the non-exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals from those courts.

Nothing in this section prevents you from exercising rights available under applicable consumer law in your state or territory.

34. Severability

If any part of these Terms and Conditions is found to be invalid or unenforceable, that part will be read down or removed to the minimum extent necessary. The remaining provisions will continue to apply.

35. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and your order confirmation, constitute the entire agreement between you and Luxso in relation to your use of the website and your order, and supersede all prior discussions, communications, representations and understandings relating to their subject matter.

Nothing in this clause excludes liability for statements that cannot lawfully be excluded, including liability for misleading or deceptive conduct under the Australian Consumer Law.
